PERSONAL DATA PRIVACY POLICY RELATED TO RECRUITMENT ACTIVITIES OF VNG CORPORATION

Introduction

This policy is established to comply with relevant personal data protection laws and based on the legal requirements of  Decree No. 13/2023/NĐ-CP, ensuring compliance in data protection, which is the foundation for VNG's sustainable business activities.

This Policy includes provisions to clarify how VNG collects, uses and processes personal data related to VNG's recruitment and recruitment promotion activities (including competitions within the framework of the Recruitment Promotion Program), approved by the HR Director and effective from 01/07/2024 and replaces all prior relevant documents and guidelines (if any).

 

Definition

VNG: VNG Corporation and VNG Corporation and its Group of Companies
VNG Group of Companies:           Any subsidiary, affiliate, or company in which VNG  Corporation has investment capital or has the right to control and administer their business activities
Career Sites: The official recruitment website of VNG
Personal Data: Personal data means any information that is expressed in the form of symbol, text, digit, image, sound, or similar forms in an electronic environment that is associated with a particular natural person or helps identify a particular natural person. Personal data includes basic personal data and sensitive personal data. Personally identifiable information means any information that is formed from the activities of an individual and, when used with other maintained data and information, can identify such a particular natural person.

 

What legal basis allows us to process your Personal Data?

You understand that the provision of your Personal Data for assessing, pre-hiring, and recruitment purposes is mandatory if you want to be an employee of VNG. Your Personal Data is used primarily to assess your suitability for the position for which you are applying and, if successful, to facilitate your employment process. VNG is committed to collecting only Personal  Data that is necessary for each of the purposes listed in this Policy. In an effort to comply with the legal regulations on personal data protection, VNG informs you of the grounds for processing Personal Data. We will be based on one of the following legal basis:

  • Carrying out lawful recruitment and recruitment promotion activities of VNG and its Group of Companies;
  • Performing legal obligations or providing information to competent authorities or law enforcements;
  • Respecting the rights of Candidate: VNG ensures the rights of data subjects shall be fully in accordance with relevant laws.

This Policy is governed by the laws of Vietnam, and any disputes arising out of this Policy will be resolved by the competent courts in Vietnam.

 

What Personal Data does VNG collect from the Candidates?

Within the scope of recruitment activities, VNG collects basic personal data as follows:

  • Family name, middle name, and first name as stated in the birth certificate, and other names (if any);
  • Date of birth;
  • Gender;
  • Residential information (including place of permanent residence, place of temporary residence, place of current residence, hometown, contact address;);
  • Nationality;
  • Marital status;
  • Phone number;
  • Email address;
  • Contents, images, sounds, and videos of individuals when providing to VNG;
  • Work experience/history;
  • Information on learning and education history;
  • Information on relevant degrees and certificates;
  • Other information contained in and collected during your application and related documents, including any referral information provided to VNG;

 

In some cases, VNG may collect sensitive personal data, including the following:

  • Information about health status contained in health examination report documents;
  • Information in the criminal record provided by you (if any).

 

When does VNG collect Personal Data of Candidate?

VNG collects and uses the Personal Data that you provide as part of our recruitment process. VNG may collect personal data in the following cases:

  • When you visit the Official Recruitment Website of VNG;
  • When you submit any application or form, including but not limited to, the application form or other forms in connection with any of our job advertisements;
  • When you interact with VNG, such as by telephone call, online chat application, face-to-face meeting, interview, social media platform, postal mail or email, or via the website.
  • When the employer, recruitment agency, or other third parties refer a Candidate applying to VNG and submit any documents on behalf of the Candidate. In such case, VNG understands that the Candidate has provided necessary consent to such relevant parties permitting them to provide such personal data to VNG;
  • When you provide relevant documents and information during your interaction with VNG, or information that you have posted publicly;
  • When you provide VNG with an assessment or response from the survey; or
  • When you provide your Personal Data to VNG for any reasons.

 

Consent for processing Personal Data

  • By applying for any of VNG's job advertisements posted on the Official Recruitment Website or on other affiliated recruitment platforms of VNG, and/or registering an account on VNG's Official Recruitment Page and/or disclosing any Personal Data to VNG,  you agree (without any restriction or limitation) and accept for VNG to collect, process, use, storage, transfer, disclosure, and announce of such Personal Data to the relevant parties in accordance with this Privacy Policy. You may withdraw your consent at any time (see the section "Rights of Data Subjects").

 

  • VNG has the right to amend and supplement this Policy at any time and depending on the purpose, scope and content of such amendment, VNG may notify you and obtain your consent in the form as prescribed or not, depending on the provisions of the law on personal data protection at the time being.

 

Purposes for processing Personal Data

VNG may collect, use, disclose and/or process your Personal Data for one or more of the following purposes:

  • To assess your suitability for the hiring position and, if successful, facilitate onboarding and create employee record for you;
  • To assess your suitability for other appropriate positions within VNG;
  • Pre-hire: create a framework to administer compensation, expenses, benefits, insurance, benefits programs, etc., as appropriate;/ To create a framework for administering compensation, expenses, benefits, insurance, and other benefit programs during the pre-hire phase.
  • To review your experience with recruitment process;
  • To review and/or process your application/registration with VNG;
  • To provide you with career opportunities that may be of interest to you, including with VNG and VNG Group of Companies.
  • To contact or communicate with you via voice call, text message and/or fax message, email and/or via Zalo app or otherwise related to job opportunities.
  • To carry out promotional activities related to VNG's recruitment program;
  • To comply with legal processes or the requirements of current laws and competent authorities. To compile statistics and research to meet reporting requirements and/or maintain internal book or regulatory compliance;
  • Any other purposes that we notify at the time of obtaining your consent.

 

Methods of Personal Data Processing

Your Personal Data will be processed in accordance with the provisions of applicable laws by using paper, electronic means, technology-based telecommunications. VNG may also use automated data processing methods (or equivalent) towards your Personal Data if necessary to enhance the sourcing and matching process. In all cases, VNG only implements methods of Personal Data processing that ensure safety and confidentiality in accordance with the law.

By disclosing the Personal Data to VNG, you warrant that none of the following personal data shall be contained in such the personal data provided by you, in particular:

  • state secrets in accordance with Vietnamese law, the collection or disclosure of which is generally prohibited, unless approved by competent authorities;
  • family secrets of your family, which you have not been authorized to disclose to VNG by all members of the family; and
  • business secrets of other companies or legal entities; or
  • Personal Data of other subjects that you do not have a lawful right to disclose and provide.

 

Retention of Personal Data

The processing of Personal Data will begin when VNG obtains your Personal Data in the manner described in this Privacy Policy.

Your Personal Data shall be retained for as long as necessary to fulfill the purposes described in the section "Purposes for Processing Personal Data" section, i.e. currently 10 years in accordance with applicable Vietnamese Laws, and for a period thereafter as legally required or permitted by applicable law (including, for the purpose of meeting any legal, accounting or other reporting and regulatory requirements or obligations).

Upon the expiration of the data retention period (if any), or when it is no longer necessary to retain your Personal Data or other cases as required by law, VNG will stop processing and take measures to delete your Personal Data and notify you of such deletion (if possible) unless otherwise required by applicable law.

In the case you are unsuccessfully hired, for the period VNG retains your data, VNG may use this data to assess your suitability for other appropriate positions and contact you regarding these positions.

 

Who might VNG share Personal Data with?

VNG may disclose and share certain Personal Data with the following organizations during the recruitment process:

  • VNG Group of Companies: VNG may share your Personal Data within the VNG Group of Companies when required to carry out processes such as conducting group-wide reporting or making decisions about selection or promotion.
  • Personal Data Processor:  VNG may engage service providers to help VNG process Personal Data. These third parties may have access to or merely store your Personal Data, but VNG contractually guarantees that all third parties must process your Personal Data in a secure and confidential manner.
  • Competent State Authorities (e.g. Tax Authorities or  Social Security Authorities): VNG may be required to share Personal Data pursuant to an order or request from a court, or party involved into legal proceedings or Competent State Authorities; or to comply with statutory requirements; or to commit obligations to the Competent State Authorities.

VNG will not transfer your Personal Data to any third party for their marketing purposes.

 

Personal Data Relating to Children

VNG shall not collect or maintain any Personal Data or information from individuals under the age of 16, nor does any portion of VNG's Career Sites shall direct to them. VNG will remove and/or delete any Personal Data that VNG believes it has been submitted by any child under the age of 16.

 

Rights of Data Subject

If you choose not to register or do not provide Personal Data, you will not be able to participate in the recruitment process of VNG.

You may exercise the following rights related to your Personal Data in accordance with VNG's internal policies at the time being, in accordance with current Vietnamese laws:

  • Right to be informed: You shall be made aware of any operation of processing of your personal data unless otherwise provided by law.
  • Right to consent: You may or may not consent to the processing of your personal data, unless otherwise as prescribed by applicable law.
  • Right to access (to information): You may access to view, edit or request to edit your personal data, unless otherwise required by law.
  • Right to withdraw consent: You may withdraw your consent, unless otherwise provided by law.
  • Right to delete data: You may delete or request for deletion of your personal data, unless otherwise provided for by law.
  • Right to restrict data processing: You may request to limit the processing of your personal data, unless otherwise provided by law. The restriction of data processing shall be effected within 72 hours after your request for all the personal data requested for restriction of data processing by you, unless otherwise provided by law.
  • Right to provision of data: You may request the Personal Data Controller or the Personal Data Controller and Processor to provide you with your own personal data, unless otherwise provided by law.
  • Right to object to data processing: You may object to the processing of your personal data by the Personal Data Controller or Personal Data Controller and Processor to prevent or limit the disclosure of your personal data or the use of your personal data for advertising or marketing purposes, unless otherwise provided  by law. VNG will process your request within 72 hours after receiving the request, unless otherwise provided by law. In specific cases where we restrict the processing of your Personal Data, we may not be able to carry out certain activities related to the recruitment of you.
  • Right to complain, denounce and/or initiate lawsuits: You may complain, denounce or initiate lawsuits in accordance with the law in case we violate applicable laws related to personal data protection;
  • Right to claim damages: You are entitled to claim damages in accordance with the law upon violation of the regulations on personal data protection if there are grounds to believe that our violation affects your legitimate interests;
  • Right to self-defense: You are entitled to self-defense in accordance with the provisions of the Civil Code and other relevant laws.
